Abstract

The House of Representatives' decision to dismiss Prof. Dr. Aswanto, S.H., M.Si. D.F.M. as one of the constitutional judges in his term of office and replacing him with Prof. Dr. Guntur Hamzah, S.H., M.H. reaped many pros and cons both from legal circles and in society. The dismissal of Judge Aswanto and the appointment of Guntur Hamzah as a replacement was carried out by the DPR through a plenary meeting of the DPR. The DPR's decision was considered arbitrary because it was made without the authority to dismiss constitutional judges, and it violated various statutory provisions regarding the independence of the Constitutional Court, the appointment mechanism and the dismissal of constitutional judges. However, the DPR considers that its action to dismiss constitutional judges is in accordance with statutory provisions, which means that based on the authority to propose constitutional judges, the DPR can evaluate the constitutional judges it proposes. This research discusses the juridical aspects of the dismissal of Judge Aswanto and the appointment of Guntur Hamzah as his replacement by the House of Representatives. The research method used in this study is normative research method, using statutory approach and case approach. The results showed that in the statutory provisions, the DPR does not have the authority to dismiss constitutional judges. In addition, the mechanism for appointing and dismissing constitutional judges carried out by the DPR violates the provisions in Article 20 paragraph (2) and Article 23 of Law Number 7 of 2020 concerning the Constitutional Court. D.F.M., hakim konstitusi dalam masa jabatan dan menggantinya dengan Prof. Dr. Guntur Hamzah, S.H., M.H. menuai banyak pro dan kontra baik dari kalangan hukum maupun dalam masyarakat. Pemberhentian Hakim Aswanto dan penunjukan Guntur Hamzah sebagai pengganti dilakukan oleh DPR melalui rapat paripurna DPR. Keputusan DPR tersebut termasuk dalam tindakan sewenang-wenang karena dilakukan tanpa adanya wewenang untuk memberhentikan hakim konstitusi, serta menabrak berbagai ketentuan perundang-undangan mengenai independensi Mahkamah Konstitusi dan mekanisme pengangkatan serta pemberhentian hakim konstitusi. Akan tetapi DPR menganggap bahwa tindakan DPR memberhentikan hakim konstitusi telah sesuai dengan ketentuan perundang-undangan, dimana DPR mengartikan atas dasar wewenang mengajukan hakim konstitusi DPR dapat melakukan evaluasi terhadap hakim konstitusi yang diajukannya. Tulisan ini membahas mengenai aspek yuridis pemberhentian hakim Aswanto dan penunjukan Guntur Hamzah sebagai penggantinya oleh Dewan Perwakilan Rakyat. Metode yang digunakan adalah metode penelitian normatif, dengan menggunakan pendekatan perundang-undangan (statuta approach) dan pendekatan kasus (case approach). Hasil menunjukkan bahwa dalam ketentuan perundang-undangan DPR tidak memiliki wewenang memberhentikan hakim konstitusi disamping itu, mekanisme pengangkatan dan pemberhentian hakim konstitusi yang dilakukan oleh DPR menabrak ketentuan dalam Pasal 20 ayat (2) dan Pasal 23 UU Nomor 7 Tahun 2020 tentang Mahkamah Konstitusi.
