Abstract

The Prosecutor's Office is a government institution that exercises judicial power in the field of prosecution. The Prosecutor's Office which is firmly located in the executive domain has created ambiguity regarding the position of the Prosecutor's Office, because on the one hand the Prosecutor's Office is under the executive but on the other hand it is connected to judicial duties, giving rise to various conflicts and debates among the public. The aim of this research is to analyze the authority of the Prosecutor's Office as a government institution in the judicial sector in terms of Law Number 11 of 2021. This type of research is normative legal research using statutory, and conceptual approaches. The results of the analysis show that there is a complexity in the relationship between the prosecutor's office and the executive and judiciary in exercising judicial power as a government institution, where in its implementation the prosecutor's office often raises several problems involving interactions with other law enforcement agencies. Therefore, further efforts are needed to reposition the Prosecutor's Office and improve a fair and effective justice system so that it can function well and meet public trust.
