T ANGGUNG JA WAB PERUSAHAAN ASURANSI TERHADAP KORBAN KECELAKAAN LAL U LINT AS JALAN RAY A DALAM PERSPEKTIF KEPASTIAN HOKUM DAN KEADILAN ABSTRAK Tujuan penelitian disertasi ini adalah: 1. Untuk mengetahui dan menganalisis tentang pengaturan tanggung jawab perusahaan asuransi terhadap korban kecelakaan lalu lintas jalan raya dalam perspektif kepastian hukum dan keadilan. 2. Untuk menganalisis dan mengkritisi pengaturan tanggung jawab perusahaan asuransi terhadap korban kecelakaan lalu lintas jalan raya apakah sudah memenuhi prinsip kepastian hukum dan keadilan. 3. Untuk memformulasikan pengaturan tanggung jawab perusahaan asuransi terhadap korban kecelakaan lalu lintas jalan raya yang lebih ideal atau yang dicita-citakan (ius constituendum) baik secara filosofis maupun secara normatif, sehingga dapat mewujudkan kepastian hukum dan keadilan. Berdasarkan tujuan penelitian di atas, maka dapat dirumuskan permasalahannya, yakni: 1. Bagaimanakah pengaturan tanggung jawab perusahaan asuransi terhadap korban kecelakaan lalu lintas jalan raya dalam perspektif kepastian hukum dan keadilan? 2. Apakah pengaturan tanggung jawab perusahaan asuransi terhadap korban kecelakaan lalu lintas jalan raya sudah memenuhi prinsip kepastian hukum dan keadilan? 3. Bagaimanakah pengaturan tanggung jawab perusahaan asuransi terhadap korban kecelakaan lalu lintas jalan raya yang lebih ideal atau yang dicita-citakan (ius constituendum), sehingga dapat mewujudkan kepastian hukum dan keadilan? Untuk merealisasikan tujuan penelitian dan rumusan masalah di atas, maka metode yang digunakan adalah metode penelitian juridis normatif, yakni suatu metode penelitian hukum yang mengkaji tentang tanggung jawab perusahaan asuransi terhadap korban kecelakaan lalu lintas jalan raya dalam perspektif kepastian hukum dan keadilan. Hasil penelitian ini membuktikan, bahwa tanggung jawab perusahaan asuransi terhadap korban kecelakaan lalu lintas jalan raya adalah tanggung jawab berdasarkan kesalahan. Sebagai saran atau rekomendasi dari penelitian ini, antara lain adalah dengan perkembangan informasi dan teknologi yang semakin maju dan pesat, maka sudah saatnya diperlukan regulasi yang lebih tegas dan limitatif terhadap pengaturan tanggung j awab perusahaan asuransi terhadap korban kecelakaan lalu lintas jalan raya. Selain itu, juga diperlukan komitmen yang tinggi antara para pihak untuk saling menghormati hak dan kewajiban masing-masing, terutama dalam melaksanakan tanggung jawab perusahaan asuransi terhadap korban kecelakaan lalu lintas jalan raya, sehingga dapat mewujudkan kepastian hukum dan keadilan. INSURANCE COMPANIES' RESPONSIBILITIES TOW ARDS ROAD TRAFFIC ACCIDENT VICTIMS FROM THE PERSPECTIVE OF LEGAL CERTAINTY AND JUSTICE ABSTRACT The objectives of this dissertation research are: 1. To find out and analyze the regulation of insurance companies' responsibilities towards road traffic accident victims from the perspective of legal certainty and justice. 2. To analyze and criticize insurance companies' responsibility arrangements for road traffic accident victims to see whether they fulfill the principles of legal certainty and justice. 3. To formulate a more ideal or aspired regulation of insurance company responsibility for road traffic accident victims (ius constituendum) both philosophically and normatively, so as to realize legal certainty and justice. Based on the research objectives above, the problem can be formulated, namely: 1. How is insurance company responsibility regulated for road traffic accident victims from the perspective of legal certainty and justice? 2. Do insurance companies' responsibility arrangements for road traffic accident victims comply with the principles of legal certainty and justice? 3. How is the insurance company's responsibility for road traffic accident victims regulated that is more ideal or aspired to (ius constituendum), so that legal certainty and justice can be realized? To realize the research objectives and problem formulation above, the method used is a normative juridical research method, namely a legal research method that examines the responsibility of insurance companies towards road traffic accident victims from the perspective of legal certainty and justice. The results of this research prove that the insurance company's responsibility towards road traffic accident victims is a responsibility based on fault. As a suggestion or recommendation from this research, among other things, with the increasingly advanced and rapid development of information and technology, it is time for stricter and more restrictive regulations to regulate insurance companies' responsibilities towards road traffic accident victims. Apart from that, a high level of commitment is also required between the parties to respect each other's rights and obligations, especially in carrying out the insurance company's responsibilities towards road traffic accident victims, so that legal certainty and justice can be achieved.
