Abstract

The purpose of this research is to know and analyze the discretionary authority of police officers based on legislation. The formulation of the problem used is How are the restrictions on the discretionary authority of police officials based on laws and regulations and What are the legal consequences for police officials who violate discretionary authority. The research method used is Normative Juridical with Legislation approach, conceptual approach, case approach. The results showed that: In the implementation of discretionary actions taken by the police must be based on Article 18 paragraph 1 of Law Number 2 of 2002 concerning the Indonesian National Police, and are required to be professional while maintaining the good name of the police agency. the implementation of discretion there are several limitations based on legislation: 1) Discretionary restrictions based on Law Number 2 of 2002. 2) Limitation of police discretion based on National Police Chief Regulation No. 14 of 2011. 3) Limitation of Police Discretion Based on National Police Chief Regulation No. 8 of 2009. 4) Restrictions on Police Discretion based on Law Number 8 of 1981). However, what happens in the field is that many police officers abuse their authority in making decisions. legal consequences for police officers who violate discretionary authority that acts excessively and not in accordance with the rule of law, then subject to punishment.
