Abstract
This research aims to; (1) Understand and analyze the legal arrangements for the procurement of goods and services in the upstream oil and gas sector. (2) Understand and analyze the legal aspects of fairness in the procurement of goods and services in the oil and gas sector. (3) Find the ideal legal construction about the procurement of goods and services in the upstream oil and gas sector. This research uses a normative method with descriptive, systematic, and explanatory steps against the positive law in depth, using conceptual approaches, legislative approaches, historical legal approaches, and political legal approaches. The research results show that; the procurement of goods and services in the oil and gas sector, as regulated by the Oil and Gas Law and Ministerial Regulation No. 8 of 2017 on Gross Split, still has legal issues in its implementation, particularly related to the legal rules for procurement of goods and services that ensure legal certainty and fairness, as outlined in PTK 007 of 2023 as the legal basis for the operational procedures, technical guidelines, and administrative guidelines that are integrated and clear, ensuring that all managers of upstream oil and gas activities in the Republic of Indonesia understand and apply the procurement of goods and services in a timely, effective, efficient, and accountable manner, supporting the operations of the oil and gas industry and creating a multiplier effect for the national economy. The legal construction in the procurement of goods and services in the upstream oil and gas sector in the future will begin with the coordination and harmonization of related regulations for the procurement of goods and services in the upstream oil and gas sector, with a focus on the return of government authority to participate in the procurement of goods and services by contractors under the gross split contract, and the return of the procurement mechanism for goods and services in the upstream oil and gas sector based on the procurement mechanism or tender for the procurement of goods and services in the upstream oil and gas sector.
