Abstract

This thesis aims to analyze the security of digital data in electronic documents seized by investigators. The research questions addressed in this writing are: 1) How is the seizure of electronic documents regulated in legislation? 2) What is the future perspective of criminal law policy regarding the seizure of electronic documents? This thesis employs a normative research method, utilizing legislative, conceptual, and case approaches. The legal materials used include primary, secondary, and tertiary legal sources. The analysis of these legal materials is conducted by identifying, interpreting, and evaluating the existing legal materials in relation to the issues discussed. The findings of this thesis indicate that: 1) The seizure of electronic documents is regulated under the Minister of Communication and Informatics Regulation Number 7 of 2016. However, this regulation still relies on the seizure procedures outlined in the Criminal Procedure Code (KUHAP), which focuses on physical objects, thus making it not entirely relevant to the developments in digital technology and the unique characteristics of electronic data. 2) There are currently no comprehensive technical regulations governing the authority to seize, the implementation procedures, the criteria for seized objects, as well as mechanisms for the storage, return, and destruction of seized electronic items. Based on these findings, the author recommends: 1) A legal reform to comprehensively regulate the seizure of electronic documents to ensure the security of electronic data, both during the seizure process and post-seizure. 2) The formulation of rules that clarify the scope of seized objects, including "physical objects" and "digital data," as well as effective technical procedures for securing and managing seized objects.
