Abstract

Penelitian ini bertujuan untuk mengeksplorasi perlindungan hukum terhadap pencipta lagu daerah Jambi yang diputar secara komersial, di mana lagu daerah Jambi sebagai bagian dari warisan budaya memiliki nilai estetika dan historis yang signifikan, namun sering kali pencipta lagu menghadapi masalah terkait pengakuan dan perlindungan hak cipta ketika karyanya digunakan untuk tujuan komersial. Penelitian ini menggunakan metode penelitian yuridis empiris yang melibatkan pengumpulan data melalui wawancara dengan pencipta lagu, pengguna lagu (user), dan pengambilan data pihak terkait lainnya, serta analisis terhadap regulasi hukum yang berlaku. Hasil penelitian menunjukkan bahwa meskipun terdapat regulasi yang mengatur perlindungan hak cipta, emplementasinnya masih menghadapi berbagai kendala, termasuk kurangnya pemahaman tentang hak-hak cipta di kalangan pencipta dan pengguna lagu. Penelitian ini merekomendasikan perlunya peningkatan kesadaran hukum, penguatan kelembagaan yang mendukung perlindungan hak cipta. Dengan demikian, diharapkan pencipta lagu daerah Jambi dapat lebih terlindungi dan dihargai dalam konteks penggunaan komersial karya mereka. This research uses empirical juridical research methods which involve data collection through interviews with songwriters, song users, and data collection from other related parties, as well as analysis of applicable legal regulations. The research results show that even though there are regulations governing copyright protection, their implementation still faces various obstacles, including a lack of understanding about copyright among song creators and users. This research recommends the need to increase legal awareness, strengthening institutions that support copyright protection. In this way, it is hoped that Jambi folk songwriters can be better protected and appreciated in the context of the commercial use of their work. Keywords: Copyright, Royalty, License
