Abstract

ABSTRAK Penelitian ini bertujuan 1) untuk mengetahui dan memahami tentang Pengaturan Hak Restitusi Terhadap Korban Tindak Pidana Dalam Peraturan Perundang-Undangan; 2) Untuk mengetahui dan memahami Kebijakan Hukum Pidana Pemberian Hak Restitusi Terhadap Korban Tindak Pidana Pencemaran Nama Baik. Metode Penelitian ini adalah penelitian Yuridis Normatif. Hasil penelitian menunjukan bahwa 1) Pengaturan Hak Restitusi Terhadap Korban Tindak Pidana Dalam Peraturan Perundang-Undangan; 2) Kebijakan Hukum Pidana Pemberian Hak Restitusi Terhadap Korban Tindak Pidana Pencemaran Nama Baik. Restitusi dapat membantu korban mendapatkan ganti rugi atau kompensasi atas kerugian yang dialami karena tidak ada pengaturan restitusi yg jelas untuk korban tindak pidana pencemaran nama baik. Diharapkan dengan adanya kebijakan peraturan khusus tentang hak restitusi, korban akan lebih terlindungi dan lebih mudah memperoleh hak yang seharusnya mereka terima. Kata Kunci: Restitusi, Tindak Pidana Pencemaran Nama Baik. ABSTRACT This research aims 1) to find out and understand the Regulations on the Rights of Restitution for Crime Victims in Legislation; 2) To know and understand the Criminal Law Policy Providing the Right to Restitution to Victims of Crimes of Defamation. This research method is normative juridical research. The results of the research show that 1) Regulation of the Rights of Restitution for Victims of Crime in Legislation; 2) Criminal Law Policy Grants the Right to Restitution to Victims of Crimes of Defamation. Restitution can help victims obtain compensation or compensation for losses experienced because there are no clear restitution arrangements for victims of criminal acts of defamation. It is hoped that with the existence of a special regulatory policy regarding the right to restitution, victims will be better protected and more easily obtain the rights they should receive.
