Abstract

ABSTRAK Pelayanan kesehatan pada lanjut usia merupakan hal yang fundamental, mengingat menurunnya kondisi fisik lanjut usia yang menyebabkan resiko timbulnya penyakit degeneratif. Pemerintah Daerah Provinsi Jambi melakukan penyelenggaraan pelayanan kesehetan lanjut usia mengacu pada Peraturan Daerah Provinsi Jambi Nomor 16 Tahun 2019 tentang Penyelenggaraan Kesejahteraan Lanjut Usia. Penelitian ini memiliki rumusan masalah yang menarik untuk dikaji, yaitu: Pertama, bagaimana pengaturan pelayanan kesehatan menurut peraturan perundang-undangan.? Kedua, bagaimana kebijakan pelayanan kesehatan untuk lanjut usia dalam beberapa peraturan daerah di Indonesia?. penelitian ini merupakan penelitian normatif dengan isu hukum kekaburan norma. Hasil dari penelitian ini yaitu, Pertama, Pelayanan Kesehatan pada lanjut usia mengacu pada beberpa peraturan seperti Undang-Undang Nomor 13 Tahun 1998 tentang Kesejahteraan Lanjut Usia, Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan, Undang-Undang Nomor 40 Tahun 2004 tentang Sistem Jaminan Sosial Nasional dan Peraturan Menteri Kesehatan Nomor 67 Tahun 2015 tentang Penyelenggaraan Kesehatan Lanjut Usia di Pusat Kesehatan Masyarakat. Kedua, terdapat kekaburan norma pada Pasal 11 ayat (1), Pasal 11 ayat (3) huruf a dan d, dan Pasal 11 ayat (4) Peraturan Daerah Provinsi Jambi Nomor 16 Tahun 2019 tentang Penyelenggaraan Kesejahteraan Lanjut Usia dimana terjadi potensi multitafsir pada beberapa pasal tersebut terkait penyelenggaraan pelayanan kesehatan untuk lanjut usia yang menyebabkan ketidakjelasan pada proses implementasinya. Kata Kunci: Pemerintah Daerah, Pelayanan Kesehatan, Lanjut Usia ABSTRACK Health services for the elderly are fundamental, given the declining physical condition of the elderly which causes the risk of degenerative diseases. The Jambi Provincial Government organizes elderly health services referring to Jambi Provincial Regional Regulation Number 16 of 2019 concerning the Implementation of Elderly Welfare. This research has an interesting problem formulation to study, namely: First, how is the regulation of health services according to laws and regulations? Second, how is the health service policy for the elderly in several regulation in Indonesia? This research is a normative research with legal issues of norm ambiguity. The results of this study are, First, Health Services for the elderly refer to several regulations such as Law Number 13 of 1998 concerning Elderly Welfare, Law Number 17 of 2023 concerning Health, Law Number 40 of 2004 concerning the National Social Security System, and Regulation of the Minister of Health Number 67 of 2015 concerning the Implementation of Elderly Health at Community Health Centers. Second, there is norm ambiguity in Article 11 paragraph (1), Article 11 paragraph (3) letters a and d, and Article 11 paragraph (4) of Jambi Province Regional Regulation Number 16 of 2019 concerning the Implementation of Elderly Welfare where there is potential for multiple interpretations in several of these articles related to the provision of health services for the elderly which causes uncertainty in the implementation process.
