Abstract

ABSTRACT The correctional system in Indonesia is regulated in Law Number 22 of 2022 concerning Corrections. Correctional Institutions (Lapas) have a primary role in developing prisoners so that they can return to being productive individuals after serving their sentences. However, prisons in Indonesia, including Class II B Muara Bungo Prisons, face serious problems in the form of Over Capacity which has an impact on the quality of inmate development and the protection of their rights. Data shows that Muara Bungo Class II B Prison is experiencing a very high level of Over Capacity, reaching 376% in 2024, which hinders the development of inmates and the protection of their rights. The aim of this research is to analyze efforts to resolve overcapacity through remission, assimilation, parole and other programs, as well as identifying obstacles in their implementation. This research uses empirical legal methods with interviews, surveys and field observations as well as secondary data in the form of statutory regulations and related literature. The research results show that although these programs contribute to reducing crowding, there are obstacles such as limited resources, facilities and social stigma. This research suggests the need to improve facilities, increase the number of officers, and better socialization to achieve optimal results in resolving overcapacity problems.
