Abstract

ABSTRAK Tujuan dari penelitian ini adalah untuk mengetahui dan menganalisis pengaturan perlindungan hukum terhadap anak sebagai korban bullying serta perlindungan hukum terhadap anak sebagai korban bullying di masa yang akan datang. Berdasarkan rumusan masalah yaitu, bagaimana pengaturan perlindungan hukum terhadap anak sebagai korban bullying dan bagaimana perlindungan hukum terhadap anak sebagai korban bullying di masa yang akan datang. Penelitian ini merupakan penelitian hukum yuridis normatif, yaitu suatu penelitian yang mencari kepastian hukum dengan mengkaji bahan-bahan hukum dengan cara menelaah teori-teori hukum, konsep dan asas-asas hukum serta peraturan perundang-undangan yang berhubungan dengan penelitian ini. Penulis tertarik untuk menganalisis, mengevaluasi, dan mengusulkan strategi perlindungan hukum yang efektif bagi anak-anak yang menjadi korban bullying. Analisis ini mencakup tinjauan terhadap undang-undang dan regulasi yang ada saat ini, identifikasi kekurangan dalam sistem perlindungan yang berlaku, serta rekomendasi untuk peningkatan hukum di masa yang akan datang. Seperti terdapat kekaburan norma pada Pasal 76C Undang-Undang Perlindungan Anak, yaitu tidak adanya penjelasan isi pasal terutama pada frasa “membiarkan” yang memiliki makna yang sangat luas. Pengaturan perlindungan hukum terhadap anak korban bullying di Indonesia masih memiliki banyak kekurangan, untuk mengatasi kekurangan ini, perlu ada perbaikan dan penambahan regulasi yang lebih spesifik, serta upaya berkelanjutan dalam pendidikan, sosialisasi, dan penegakan hukum untuk memastikan perlindungan yang efektif bagi anak korban bullying di Indonesia. Kata Kunci: Perlindungan Hukum, Anak Korban, Bullying Abstract The purpose of this study is to determine and analyze the regulation of legal protection for children as victims of bullying and legal protection for children as victims of bullying in the future. Based on the formulation of the problem, namely, how is the regulation of legal protection for children as victims of bullying and how is the legal protection for children as victims of bullying in the future. This study is a normative juridical legal research, namely a study that seeks legal certainty by examining legal materials by examining legal theories, concepts and principles of law and laws and regulations related to this research. The author is interested in analyzing, evaluating, and proposing effective legal protection strategies for children who are victims of bullying. This analysis includes a review of existing laws and regulations, identification of deficiencies in the applicable protection system, and recommendations for improving the law in the future. As there is a vagueness of norms in Article 76C of the Child Protection Law, namely the absence of an explanation of the contents of the article, especially the phrase "allowing" which has a very broad meaning. The legal protection arrangements for child victims of bullying in Indonesia still have many shortcomings. To overcome these shortcomings, there needs to be improvements and additions of more specific regulations, as well as ongoing efforts in education, socialization, and law enforcement to ensure effective protection for child victims of bullying in Indonesia.
