Abstract

This thesis aims to find out, analyze, and comparing community service of the Republic Indonesia Law Number 1 of 2023 on the Criminal Code with community service in the Netherlands. This study uses a normative legal type, using the statue approach method, conceptual approach and comparative approach. The results of this study show similarities and differences in the regulation of community service in both countries. Both countries use social work punishment as an alternative to short-term imprisonment and light fines. The Netherlands has implementing regulations and supervisory regulations, thus distinguishing it from Indonesia which does not have implementing and supervisory regulations. It is hoped that there will be a formulation of implementing regulations and supervisory regulations for community service in Indonesia so that if Republic Indonesia Law Number 1 of 2023 on the Criminal Code, convicts can carry out social work punishment properly and the objectives of the punishment can be achieved.
