Abstract

Criminal law enforcement in Indonesia faces challenges in determining criminal liability for perpetrators who claim to have mental disorders. Article 44 of the Criminal Code provides an exception for individuals who cannot be held responsible for their actions due to mental disorders. However, this provision is often misused as an attempt to defend themselves to avoid criminal penalties. This study aims to analyze the standard criteria used in Indonesian criminal law to determine the validity of claims of mental disorders and evaluate legal policies in dealing with the misuse of this reason. The research method used is normative juridical with a statutory approach and analysis of related court decisions. The results of the study show that in practice, courts often face difficulties in proving whether a defendant actually has a mental disorder or is just pretending. Medical and psychiatric examinations are the main instruments in determining the capacity for responsibility of perpetrators of criminal acts. The Nasional Criminal Code provides a more comprehensive approach with the option of reducing criminal sentences or certain legal actions for perpetrators with mental disabilities. The conclusion of this study confirms that a stricter legal policy is needed in assessing mental disorder claims as well as a control mechanism to prevent abuse of this rule. Stricter psychiatric examinations and the involvement of experts in the judicial process are important factors in ensuring justice for victims and legal certainty for perpetrators.
