Abstract
The aim of this research is to determine and analyze the legal arrangements related to the protection of environmental activists in Indonesia, and the implementation of the protection of environmental activists based on regulations related to the rights given to environmental activists in fighting for a good and healthy environment. Based on applicable regulations, environmental fighters and defenders who fight for environmental rights cannot be criminally prosecuted and cannot be sued civilly. However, in its implementation in Indonesia, there are cases where taking action to fight for a good and healthy environment comes into contact with articles of criminal law, and is considered an act that violates the law. This is an act of SLAPP (Strategic Law Suit Public Participation) with the aim of weakening their actions. The research method used is empirical juridical, with data collection techniques using interviews. The results of the research show that actions that protect the environment from environmental damage and/or pollution are actions that are protected by several related statutory arrangements, with the assessment of the actions of environmental activists as environmental defenders through the values of the principles of proportionality and subsidiarity which are taken into consideration by law enforcers. However, its implementation is not in accordance with applicable regulations, because the interpretation of the meaning of fighting for a good and healthy living environment has not been fully achieved.
