Abstract

This study aims to analyze whether land sales based on customary law in Arang-Arang Village provide legal certainty and protection, Kumpeh Ulu District, Muaro Jambi Regency. The focus of the study is to understand the process, rules, and customary values that underlie land sales transactions, and to identify the factors that cause land sales in Arang-arang Village, Kumpeh Ulu District, Muaro Jambi Regency to still be carried out based on customary law. The research method used is qualitative with an empirical approach, where data is collected through in-depth interviews with customary leaders, village heads, landowners, and local communities, as well as related document studies. The results of the study indicate that land sales in Arang-Arang Village are still heavily influenced by customary law, where agreements between the parties involved must be witnessed by customary leaders, village heads and local communities. This study concludes that customary law still has strong relevance in regulating land sales in Arang-Arang Village, despite challenges in facing modernization and national legal regulations. The implication of this finding is the importance of maintaining a balance between customary law and state law to ensure legal protection and certainty for the community.
