Abstract

Penelitian ini mengkaji penegakan hukum terhadap peredaran narkotika melalui dark web, sebuah platform anonim yang sering digunakan untuk aktivitas ilegal. Kemajuan teknologi telah memfasilitasi modus operandi baru dalam peredaran narkotika yang menimbulkan hambatan signifikan bagi aparat penegak hukum. Penelitian ini bertujuan untuk mengetahui pengaturan hukum pidana terhadap peredaran narkotika melalui dark web dalam perspektif perundang-undangan serta merumuskan kebijakan peraturan yang efektif untuk mengatasi masalah ini di masa depan. Metode yang digunakan dalam penelitian adalah pendekatan yuridis normatif, dengan menganalisis peraturan perundang-undangan terkait, seperti Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika dan Undang-Undang Nomor 1 Tahun 2024 tentang Perubahan Atas Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik, serta studi kasus. Penelitian ini diharapkan dapat memberikan rekomendasi praktis bagi pemerintah dan lembaga penegak hukum dalam upaya menanggulangi peredaran narkotika melalui dark web. Dalam penelitian ini menekankan pentingnya kolaborasi antara berbagai pihak baik ditingkat nasional maupun internasional dan harmonisasi peraturan perundang-undangan untuk mengatasi kompleksitas kejahatan peredaran narkotika di era digital. Penelitian ini meyoroti perlunya peningkatan kapasitas aparat penegak hukum dalam menghadapi kejahatan siber narkotika, serta pentingnya kerja sama lintas negara dalam anggota peredaran narkotika melalui dark web. Kata kunci : Narkotika, Dark Web, Penegakan Hukum. This research examines law enforcement against drug trafficking through the dark web, an anonymous platform often used for illegal activities. Technological advances have facilitated a new modus operandi in narcotics trafficking that poses significant obstacles for law enforcement officials. This study aims to determine the criminal law regulation of narcotics trafficking through the dark web in the perspective of legislation and formulate effective regulatory policies to overcome this problem in the future. The method used in the research is a normative juridical approach, by analyzing relevant laws and regulations, such as Law Number 35 of 2009 on Narcotics and Law Number 1 of 2024 on Amendments to Law Number 19 of 2016 on Amendments to Law Number 11 of 2008 on Electronic Information and Transactions, as well as case studies. This research is expected to provide practical recommendations for the government and law enforcement agencies in an effort to tackle narcotics trafficking through the dark web. This study emphasizes the importance of collaboration between various parties both at the national and international levels and harmonization of laws and regulations to overcome the complexity of drug trafficking crimes in the digital era. This research highlights the need to increase the capacity of law enforcement officials in dealing with narcotics cybercrime, as well as the importance of law enforcement in dealing with narcotics cybercrime.
