Abstract

Penelitian ini mengkaji mengenai mekanisme pengaturan dan perlindungan korban dalam penyelesaian tindak pidana hukum kekerasan berbasis gender online atau yang dapat disebut dengan KBGO. KBGO adalah kekerasan yang menyerang gender yang difasilitasi oleh internet. Tujuan penelitian ini untuk menganalisis pengaturan tindak pidana kekerasan berbasis gender online serta bentuk perlindungan yang akan diapatkan oleh korban. Permasalahan dari penelitian ini apakah pengaturan serta kebijakan hukum pidana yang ada di indonesia saat ini sudah memenuhi perlindungan serta hak-hak yang akan di dapatkan korban, serta bagaimana regulasi kebijakan yang dapat dilaksanakan untuk memenuhi hak hak korban. Penelitian ini menggunakan tipe penelitian normatif dengan menggunakan beberapa pendekatan yaitu, pendekatan perundang undangan (statute approach), pendekatan kasus (case approach), dan pendekatan konseptual (conceptual approach). Bahan hukum yang digunakan adalah bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Hasil penelitian menunjukkan bahwa adanya kebijakan hukum pidana yang harus dilakukan yaitu pada Undang Undang No 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik harus menambakan pengaturan mengenai perlindungan serta hak-hak korban seperti kompensasi serta pemulihan psikologis korban serta dalam Undang Undang No 12 Tahun 2022 Tentang Tindak Pidana Kekerasan Seksual dalam hal ini hanya dikhusukan tindak kekerasan seksual berbasis teknologi yang belum memiliki aturan turunan sehingga belum dapat mengimplementasikan secara baik perlindungan yang akan didapatkan korban. Kata Kunci : KBGO, Perlindungan, Korban, Hak This research examines the regulatory mechanisms and victim protection in the settlement of legal crimes of online gender-based violence or what can be called KBGO. KBGO is violence that attacks gender facilitated by the internet. The purpose of this research is to analyze the regulation of criminal acts of online gender-based violence and the forms of protection that will be obtained by victims. The problem of this research is whether the current criminal law arrangements and policies in Indonesia have fulfilled the protection and rights that victims will get, and how policy regulations can be implemented to fulfill the rights of victims. This research uses normative research type by using several approaches, namely, statute approach, case approach, and conceptual approach. The legal materials used are primary legal materials, secondary legal materials, and tertiary legal materials. The results showed that there is a criminal law policy that must be carried out, namely in Law No. 11 of 2008 concerning Electronic Information and Transactions, it must add arrangements regarding the protection and rights of victims such as compensation and psychological recovery of victims and in Law No. 12 of 2022 concerning Criminal Acts of Sexual Violence in this case only focused on technology-based sexual violence which does not yet have derivative regulations so that it cannot properly implement the protection that victims will get.
