Abstract

The purpose of this research is to examine and analyze the regulation of conditionally unconstitutional rulings in the formal review of laws against the 1945 Constitution of the Republic of Indonesia, as well as to formulate the ideal legal framework for conditionally unconstitutional rulings in the formal review conducted by the Constitutional Court as a form of ius constituendum. This study analyzes the legal legitimacy of the Constitutional Court's conditionally unconstitutional decision in Decision Number 91/PUU-XVIII/2020 concerning the Omnibus Law on Job Creation, and the ideal regulation of conditional unconstitutionality in formal judicial review. This research uses a normative juridical method with qualitative descriptive analysis. The findings show that although conditionally unconstitutional rulings are legally binding and must be implemented, there exists a significant incompatibility between this model of ruling and the structure and design of formal judicial review. Therefore, this study recommends that the Constitutional Court should no longer apply conditionally unconstitutional rulings in formal reviews, and should instead adopt rulings that are clear and final, declaring a law as either constitutional or unconstitutional without attaching conditions
