Abstract
ABSTRAK Penelitian ini bertujuan untuk: 1) Menganalisis bentuk pengawasan terhadap orang asing serta kendala yang dihadapi oleh Kantor Imigrasi Kelas II Kuala Tungkal, dan 2) Mengkaji prosedur penindakan terhadap pelanggaran keimigrasian yang dilakukan oleh orang asing. Penelitian ini menggunakan metode yuridis empiris, dengan teknik pengambilan sampel secara random sampling. Hasil penelitian menunjukkan bahwa pengawasan terhadap orang asing dilakukan melalui beberapa tahapan, yaitu pengumpulan data, pendaftaran orang asing, pemantauan keberadaan serta aktivitas mereka, pengolahan data dan informasi terkait kegiatan orang asing, serta koordinasi dengan instansi pemerintah terkait. Namun, dalam pelaksanaannya, terdapat berbagai kendala seperti keterbatasan jumlah personel di Kantor Imigrasi Kelas II Kuala Tungkal, minimnya informasi yang diterima dari masyarakat, serta keterbatasan anggaran untuk mendukung pengawasan. Akibatnya, masih terdapat warga negara asing yang dengan mudah menyalahgunakan izin kunjungan yang dimilikinya. Prosedur penindakan terhadap pelanggaran keimigrasian yang dilakukan oleh orang asing di Kantor Imigrasi Kelas II Kuala Tungkal mengacu pada Undang-Undang Nomor 6 Tahun 2011 tentang Keimigrasian. Salah satu langkah tegas yang diambil adalah mendeportasi warga negara asing yang terbukti menyalahgunakan izin tinggalnya. Kata Kunci: Pengawasan, Izin Tinggal, Orang Asing. ABSTRACT This research aims to: 1) Analyze the forms of supervision of foreigners and the obstacles faced by the Kuala Tungkal Class II Immigration Office, and 2) Examine the procedures for taking action against immigration violations committed by foreigners. This research uses empirical juridical methods, with random sampling techniques. The research results show that supervision of foreigners is carried out through several stages, namely data collection, registration of foreigners, monitoring their whereabouts and activities, processing data and information related to foreigners' activities, as well as coordination with relevant government agencies. However, in its implementation, there are various obstacles such as the limited number of personnel at the Kuala Tungkal Class II Immigration Office, the lack of information received from the public, and the limited budget to support supervision. As a result, there are still foreign nationals who easily abuse their visit permits. Procedures for taking action against immigration violations committed by foreigners at the Kuala Tungkal Class II Immigration Office refer to Law Number 6 of 2011 concerning Immigration. One of the firm steps taken is to deport foreign nationals who are proven to have misused their residence permits. Keywords: Supervision, Residence Permit, Foreigners.
