Abstract

The purpose of this study is to determine the criminal liability of theft against perpetrators of kleptomania and to analyze the consideration of the panel of judges in applying sanctions to perpetrators of theft who suffer from kleptomania disorder. The problem formulations in this research are: 1) How is the criminal responsibility of the perpetrator of theft with kleptomania disorder and 2) How is the consideration of the panel of judges in applying sanctions to perpetrators of theft who suffer from kleptomania disorder in Decision Number 574/Pid.B/2019/PN. Dps? The research is written using normative juridical research type by using various approaches, namely statutory approach and case approach. The results of this study are that 1) The perpetrator of kleptomania commits the crime of theft because of a strong urge to steal, which usually aims to fulfill this desire. After committing theft, offenders often feel a sense of satisfaction or happiness. Therefore, it is important to ensure that justice in law enforcement takes into account the psychological background of the perpetrator, so as to increase public confidence in the legal process. In Decision Number 574/Pid.B/2019/PN.Dps, the judge should have considered the mental health condition of the defendant who suffered from kleptomania, in accordance with Article 44 of the Criminal Code. Judges are expected to provide fair and useful decisions, and ensure that individuals with mental disorders receive appropriate health and rehabilitation services. This is important to guarantee the rights of the defendant during the trial process. Keywords: Liability, Criminal offense, Theft, Kleptomania
