Abstract

The objectives of this research are: 1) To understand and analyze the regulation of adultery as outlined in Article 284 of the Criminal Code and Article 411 of the 2023 Criminal Code, and 2) To assess and analyze the implications of the crime of adultery according to Article 411 of the 2023 Criminal Code, specifically regarding the enhancement of victim protection. The type of research is normative juridical. The results of the research indicate that the expansion of the definition of adultery in Article 411 of the 2023 Criminal Code has reoriented the legal notion of victimhood. Unlike Article 284 of the old KUHP, which limited complaints to spouses, the new provision allows parents or children of unmarried offenders to act as complainants. This shift introduces ambiguity about who qualifies as a “victim” and raises potential concerns over privacy violations, abuse of complaint rights, and legal uncertainty, especially concerning children and their protection within the law. The expanded adultery provisions in the 2023 Criminal Code illustrate a tension between moral regulation and legal certainty. While aiming to uphold societal values, the broadened scope risks over-criminalization and the victimization of parties who might otherwise be considered consenting adults or vulnerable individuals, such as minors. Clarification and further legal refinement are necessary to ensure that the application of these provisions aligns with principles of justice and child protection.
