Abstract

Penelitian ini menganalisis putusan KPPU dalam kasus Aqua vs. Le Minerale, yang berfokus pada kasus Nomor 22/KPPU/I/2016 terkait praktik persaingan usaha tidak sehat. Kasus ini melibatkan tuduhan perjanjian eksklusif dan penguasaan pasar oleh Aqua dan distributornya terhadap Le Minerale. Penelitian ini mengeksplorasi penerapan konsep persaingan usaha tidak sehat oleh KPPU dan kontroversi penggunaan frasa "pro justitia" dalam putusannya, serta dampaknya terhadap kepastian hukum dan keadilan dalam sengketa persaingan usaha, merujuk pada Undang-Undang Nomor 5 Tahun 1999 dan Putusan Mahkamah Konstitusi Nomor 85/PUU-XIV/2016. Menggunakan pendekatan yuridis normatif, penelitian ini menganalisis bahan hukum primer dan sekunder. Temuan menunjukkan bahwa putusan KPPU, yang dikuatkan oleh Mahkamah Agung, membuktikan pelanggaran Aqua terhadap Undang-Undang tersebut. Kontroversi "pro justitia" mencerminkan ketegangan antara penegakan hukum administratif dan hukum pidana, dengan klarifikasi kewenangan KPPU oleh Mahkamah Konstitusi. Penelitian ini diakhiri dengan rekomendasi untuk memperbaiki kerangka hukum dan mekanisme penegakan hukum persaingan usaha di Indonesia. This research analyzes the KPPU (Indonesian Business Competition Supervisory Commission) decision in the Aqua vs. Le Minerale case, focusing on case number 22/KPPU/I/2016. The case involved allegations of unfair business competition practices, specifically exclusive dealing and market dominance, by Aqua (PT Tirta Investama) and its distributor (PT Balina Agung Perkasa) against Le Minerale (PT Tirta Fresindo Jaya). The study examines how the KPPU applied the concept of unfair competition and the controversy surrounding the use of the phrase "pro justitia" in the KPPU's decision. It explores the impact of this controversy on legal certainty and justice in Indonesian business competition disputes, referencing Law No. 5 of 1999 concerning the Prohibition of Monopoly Practices and Unfair Business Competition and Constitutional Court Decision No. 85/PUUXIV/2016. The research employs a normative juridical approach, analyzing primary and secondary legal materials, including the relevant laws, court decisions, and scholarly literature. The findings reveal the KPPU's decision, upheld by the Supreme Court, demonstrated that Aqua's actions violated Law No. 5 of 1999. The controversy over "pro justitia" highlights the tension between administrative and criminal law enforcement, with the Constitutional Court clarifying KPPU's quasi-judicial authority. The study concludes with recommendations for improving the legal framework and enforcement mechanisms for business competition in Indonesia.
