Abstract

ABSTRAK Penelitian ini bertujuan untuk menganalisis pertanggungjawaban pidana terhadap pelaku tindak pidana penganiayaan hewan (animal abuse) dalam perspektif Undang-Undang Nomor 1 Tahun 2023 tentang KUHP. Rumusan masalah dari penelitian ini yaitu: (1) Bagaimana perumusan tindak pidana animal abuse dalam Undang-Undang Nomor 1 Tahun 2023 tentang KUHP sebagai dasar pelaku untuk dapat dipertanggungjawaban secara pidana? (2) Bagaimana cara menentukan kesalahan dan sanksi pidana terhadap pelaku animal abuse dalam Undang-Undang Nomor 1 tahun 2023. Metode penelitian yang digunakan adalah yuridis normatif. Hasil penelitian menunjukkan bahwa Pasal 337 KUHP telah memuat ketentuan pidana terhadap pelaku animal abuse, namun masih terdapat kekaburan norma karena belum diaturnya secara khusus tindak pidana pembunuhan hewan. Meskipun KUHP baru memberikan dasar hukum pemidanaan, efektivitasnya masih terbatas karena sanksi yang ringan dan rumusan yang belum komprehensif. Penulis menyarankan agar legislasi lebih lanjut dilakukan untuk memperjelas delik dan perlu adanya peningkatan sanksi pidana agar mampu memberikan efek jera bagi pelaku dan memperkuat perlindungan terhadap hewan sebagai makhluk hidup yang berhak untuk hidup tanpa kekerasan. Serta perlunya edukasi hukum kepada masyarakat guna meningkatkan kesadaran akan pentingnya kesejahteraan hewan. Kata Kunci: Pertanggungjawaban Pidana, Animal Abuse ABSTRACT This study aims to analyze criminal liability for perpetrators of animal abuse in the perspective of Law Number 1 of 2023 concerning the Criminal Code. The formulation of the problem of this study is: (1) How is the formulation of the crime of animal abuse in Law Number 1 of 2023 concerning the Criminal Code as the basis for the perpetrator to be held criminally accountable? (2) How to determine the guilt and criminal sanctions against perpetrators of animal abuse in Law Number 1 of 2023. The research method used is normative juridical. The results of the study show that Article 337 of the Criminal Code contains criminal provisions against perpetrators of animal abuse, but there is still a lack of clarity in the norms because the crime of killing animals has not been specifically regulated. Although the Criminal Code only provides a legal basis for criminal punishment, its effectiveness is still limited due to light sanctions and formulations that are not yet comprehensive. The author suggests that further legislation be carried out to clarify the crime and that there needs to be an increase in criminal sanctions in order to be able to provide a deterrent effect for perpetrators and strengthen protection for animals as living creatures who have the right to live without violence. As well as the need for legal education for the community to increase awareness of the importance of animal welfare. Keywords: Criminal Liability, Animal Abuse
