Abstract
ABSTRAK Undang-Undang Tentang Desa banyak mengalami perubahan dan revisi terkait masa jabatan dan periodisasi Kepala Desa dalam menjabat. Pada 2024 Undang-Undang Nomor 3 Tahun 2024 telah resmi disahkan, lahirnya undang-undang ini menjadi regulasi perubahan atas Undang-Undang Nomor 6 Tahun 2014 tentang Desa. Perubahan regulasi ini bayak menuai pro dan kontra dimulai dari argumentasi hukum pertambahan masa jabatan Kepala Desa yang terbilang lemah, durasi pembahasan yang terlalu singkat, serta pengesahan yang dilakukan pada waktu yang tidak tepat, yang menimbulkan dugaan adanya kepentingan politik tertentu. Namun salah satu poin penting dalam UU Desa terbaru adalah pertambahan masa jabatan Kepala Desa dari 6 tahun 3 periode menjadi 8 tahun dan dapat menjabat 2 kali secara berturut-turut maupun tidak berturut-turut. Sehingga menimbulkan perdebatan dan menyebabkan pertentangan kebijakan yang berdampak disharmonisasi Peraturan Perundang-Undangan. Hal ini berpotensi terjadinya nepotisme, potensi abuse power, dan terbukanya ceruk korupsi yang lebih besar pada tingkat desa. Jenis penelitian ini adalah yuridis normatif dengan pendekatan perundang-undangan dan komparatif berdasarkan asas pemerintahan yang baik (good governance) yang mencakup akuntabilitas, transparansi, partisipasi, dan responsivitas terhadap masyarakat. Kata Kunci: Masa jabatan, Kepala Desa, Perundang-undangan ABSTRACT The Village Law has undergone many changes and revisions related to the term of office and periodization of the Village Head in office. In 2024 Law Number 3 of 2024 was officially passed, the birth of this law became a regulation to amend Law Number 6 of 2014 concerning Villages. This change in regulation has drawn many pros and cons, starting from the legal argumentation for the increase in the term of office of the Village Head, which is fairly weak, the duration of the discussion is too short, and the ratification is carried out at an inappropriate time, which raises allegations of certain political interests. However, one of the important points in the latest Village Law is the increase in the term of office of the Village Head from 6 years and 3 periods to 8 years and can serve 2 consecutive or non-consecutive terms. This has caused debate and led to contradictory policies that have the effect of disharmonizing the Laws and Regulations. This has the potential for nepotism, potential abuse of power, and the opening of a larger niche for corruption at the village level. This type of research is normative juridical with legislative and comparative approaches based on the principles of good governance, which include accountability, transparency, participation, and responsiveness to the community.
