Abstract

Tujuan penelitian ini adalah untuk mengetahui bagaimana kedudukan Lembaga Adat Melayu (LAM) Kota Jambi dalam kelembagaan pemerintah daerah berdasarkan peraturan perundangundangan, dan untuk mengetahui bagaimana hubungan LAM Kota Jambi dan pemerintah daearah dalam melaksanakan tugas dan fungsinya. Permasalahan dari penelitian ini adalah bagaimana kedudukan LAM Kota Jambi dalam kelembagaan pemerintah daerah berdasarkan peraturan perundang-undangan, dan bagaimana hubungan LAM Kota Jambi dan pemerintah daerah dalam pelaksanaan tugas dan fungsinya. Metode penelitian yuridis normatif dengan menggunakan pendekatan peraturan perundang-undangan, pendekatan konseptual, dan pendekatan bahan hukum. Bahan hukum yang digunakan adalah bahan hukum primer, sekunder, dan tersier. Hasil penelitian ini menunjukkan bahwa Berdasarkan analisis terhadap kedudukan Lembaga Adat Melayu (LAM) Kota Jambi menunjukkan bahwa LAM mendapatkan legitimasi melalui Perda Kota Jambi No 4 tahun 2014 tentang Lembaga Adat Melayu Kota Jambi namun LAM tidak diakui secara formal dan hierarkis didalam kelembagaan pemerintah daerah Kota Jambi.Berdasarkan analisis terhadap hubungan antara Lembaga Adat Melayu (LAM) Kota Jambi dan Pemerintah Daerah Kota Jambi, dapat disimpulkan bahwa kolaborasi ini memainkan peran penting dalam penegakan hukum dan pelestarian budaya. LAM berfungsi sebagai lembaga konsultatif dan mediatif dalam penyelesaian masalah sosial, serta berperan dalam penerapan prinsip restorative justice berbasis adat. Meskipun ada tantangan dalam pengakuan hukum, pemahaman aparat penegak hukum, serta keterbatasan sumber daya, hubungan ini menunjukkan potensi besar untuk meningkatkan efektivitas penyelesaian konflik dan pemberdayaan masyarakat. Kata Kunci : Kedudukan Lembaga Adat Melayu, Kelembagaan, Pemerintah Daerah The purpose of this study is to examine the position of the Malay Traditional Institution (LAM) of Jambi City within the regional government institutional structure based on prevailing laws and regulations, and to analyze the relationship between LAM Jambi City and the local government in carrying out their respective duties and functions. The research problems addressed in this study are: (1) What is the position of LAM Jambi City in the institutional structure of the regional government according to the applicable laws and regulations? (2) How is the relationship between LAM Jambi City and the local government in the implementation of their tasks and functions? This study uses a normative juridical method with a statutory approach, a conceptual approach, and a legal materials approach. The legal materials used include primary, secondary, and tertiary legal sources. The results of this study indicate that LAM Jambi City derives its legitimacy from Jambi City Regional Regulation No. 4 of 2014 concerning the Lembaga Adat Melayu of Jambi City. However, LAM is not formally or hierarchically recognized within the institutional structure of the Jambi City regional government. The analysis of the relationship between LAM Jambi City and the regional government shows that this collaboration plays an important role in law enforcement and cultural preservation. LAM functions as a consultative and mediative institution in resolving social issues and contributes to the implementation of restorative justice principles based on customary law. Despite challenges such as legal recognition, limited understanding among law enforcement officers, and resource constraints, this relationship shows great potential to enhance conflict resolution effectiveness and community empowerment.
