Abstract

Penelitian ini bertujuan untuk memahami akan eksistensi Pasal 228A Peraturan Dewan Perwakilan Rakyat Nomor 1 Tahun 2025 Tentang Perubahan Atas Peraturan Nomor 1 Tahun 2020 Tentang Tata Tertib Dewan Perwakilan Rakyat. Adapun rumusan masalah dalam penelitian ini. Pertama, Apakah Pasal 228A dalam Tata Tertib Dewan Perwakilan Rakyat sesuai dengan ketentuan Peraturan Perundang-Undangan Indonesia. Kedua, Apakah Pasal 228A dalam Tata Tertib Dewan Perwakilan Rakyat masih relevan dan perlu dipertahankan untuk diterapkan di masa mendatang. Metode penelitan yang digunakan ialah yuridis normatif. Penelitian yuridis normatif (normative legal research) merupakan penelitian terhadap suatu norma yang ada dalam buku positif. Hasil penelitian menunjukkan Peraturan DPR Nomor 1 Tahun 2025 Tentang Perubahan Peraturan Dewan Perwakilan Rakyat Nomor 1 Tahun 2020 bukan bagian dari hierarki peraturan perundang undangan namun merupakan jenis pertauran lain yang secara konstitusi diakui guna menjadi pedoman dalam menjalankan tugasnya secara intenal dan tidak relevan adanya Pasal 228A pada Peraturan DPR Nomor 1 Tahun 2025 Pasal tersebut perlu dicabut agar konsistensi hierarki norma hukum tetap terjaga, penyalahgunaan wewenang dapat dicegah, serta prinsip independensi lembaga negara tetap terlindungi. Kesimpulan pada penelitian ini ialah dengan melakukan pencabutan atau penghapusan Pasal 228A yang dimana menimbulkan permasalah antar lembaga negara atau bertentangan dengan konstitusi Kata Kunci: Lembaga Negara, Peraturan Perundang Undangan, Dewan Perwakilan Rakyat (DPR). This research aims to understand the existence of Article 228A of the House of Representatives Regulation Number one of 2025 concerning Amendments to Regulation Number 1 of 2020 concerning the Rules of Procedure of the House of Representatives. Is Article 228A of the Rules of Procedure of the House of Representatives in accordance with the provisions of the Indonesian Legislation. Number two, Is Article 228A in the Rules of Procedure of the House of Representatives still relevant and needs to be maintained to be applied in the future? The research method used is normative juridical. Normative legal research is a study of a norm in a positive book. The results showed that House Regulation No. 1 of 2025 on Amendments to House of Representatives Regulation No. 1 of 2020 is not part of the hierarchy of laws and regulations but is another type of regulation that is constitutionally recognised to be a guideline in carrying out its duties internally and the irrelevance of Article 228A in House Regulation No. 1 of 2025 needs to be revoked so that the consistency of the hierarchy of legal norms is maintained, abuse of authority can be prevented, and the principle of independence of state institutions is protected. The conclusion of this research is to revoke or delete Article 228A, which causes problems between state institutions or contradicts the constitution.
