Abstract

PT. Zoe Trans Logistik adalah perusahaan swasta yang bergerak dalam bidang jasa pengiriman barang. Dalam proses pengiriman barang, kerap terjadi kerusakan pada barang kiriman yang mengakibatkan kerugian terhadap pengirim. Sehubungan dengan itu, yang menjadi rumusan masalah dalam penelitian ini adalah: Bagaimana pertanggungjawaban PT. Zoe Trans Logistik atas penyelesaian tuntutan ganti rugi terhadap barang yang mengalami kerusakan dan Apa saja faktor yang menjadi penyebab terjadinya kerusakan dalam pengiriman barang oleh PT. Zoe Trans Logistik. Tujuan dari penelitian ini yaitu untuk mengetahui dan menganalisis pertanggungjawaban PT. Zoe Trans Logistik atas penyelesaian tuntutan ganti rugi terhadap barang yang mengalami kerusakan dan untuk mengetahui faktor-faktor penyebab terjadinya kerusakan dalam proses pengiriman barang oleh PT. Zoe Trans Logistik. Penelitian ini menggunakan metode penelitian yuridis empiris. Adapun hasil yang diperoleh dari penelitian ini ialah: 1) Pertanggungjawaban PT. Zoe Trans Logistik atas penyelesaian tuntutan ganti rugi terhadap barang yang mengalami kerusakan belum sepenuhnya terlaksana dengan apa yang seharusnya, dikarenakan masih ada konsumen yang merasa uang ganti rugi yang diberikan tidak sesuai dengan yang telah di janjikan. 2) Faktor yang menjadi penyebab kerusakan barang dalam proses pengiriman barang oleh PT. Zoe Trans Logistik karena adanya kelalaian dari pihak ekspedisi maupun pihak konsumen itu sendiri. Oleh karena itu, perlu adanya upaya seperti membuat panduan pengemasan yang spesifik untuk setiap jenis barang, program pelatihan menyeluruh untuk semua staff handling, jadwal perawatan rutin yang ketat untuk semua kendaraan serta kerjasama strategis dengan perusahaan asuransi untuk produk khusus. Zoe Trans Logistik is a private company engaged in the field of goods delivery services via land, sea and air with operational routes that almost reach all of Indonesia. In the process of shipping goods, damage often occurs to the goods sent which results in losses to the sender. In this regard, the formulation of the problem in this study is: How is the responsibility of PT. Zoe Trans Logistik for the settlement of claims for compensation for damaged goods and What are the factors that cause damage in the delivery of goods by PT. Zoe Trans Logistik. The purpose of this study is to determine and analyze the responsibility of PT. Zoe Trans Logistik for the settlement of claims for compensation for damaged goods and to determine the factors that cause damage in the process of shipping goods by PT. Zoe Trans Logistik. This study uses an empirical legal research method. The results obtained from this study are: 1) The responsibility of PT. Zoe Trans Logistik for the settlement of claims for compensation for damaged goods has not been fully implemented as it should be because there are still consumers who feel that the compensation money given is not in accordance with what has been promised. 2) Factors that cause damage to goods in the process of shipping goods by PT. Zoe Trans Logistik due to negligence on the part of the expedition or the consumer itself. Therefore, it is necessary to make efforts such as creating specific packaging guidelines for each type of goods, comprehensive training programs for all handling staff, strict routine maintenance schedules for all vehicles and strategic cooperation with insurance companies for special products.
