Abstract
This article seeks to analyze basis ofjudge's consideration in exercisingimprisonment as a substitute for criminal fines in narcotics abuse case. Asa normative juridical research, thisstudy examineslaws and their application to court decisions regarding narcotics crime. The results of this study demonstratesthat the accumulation ofimprisonment and criminal fines in the narcotics' law has not beeneffective to urge the perpetrator paycriminal fines. In reality, the perpetrator pragmatically preferscarryingoutimprisonment to substitute sanction.The result of this researchhas supported the idea that theproblem behind the application of imprisonment as a subtitute of fines tends to be pragmaticallyfavourableto that of fines sanction. It is recommended that the policy-makers pay attention to the effectiveness of the stipulatingcriminal sanctions in the form offines by formulating a balanced legislation between the severity of imprisonment and its substitute in the form of finessanction.
