Abstract
ABSTRAK Tujuan Penelitian ini adalah untuk: 1) Untuk mengkaji dan menganalisis pengaturan hukum tindak pidana pencemaran nama baik melalui media sosial melalui Restorative Justice. 2) mengetahui dan menganalisis urgensi hukum dalam penyelesaian tindak pidana pencemaran nama baik melalui Restorative Justice. Yang mana selanjutnya perumusan masalah dalam Penelitian ini adalah: 1) Bagaimana Pengaturan Penyelesaian Tindak Pidana Pencemaran Nama Baik Melalui Restorative Justice, selanjutnya, 2) Apa Urgensi Sehingga diperlakukan Keadilan Restorative Justice Dalam Tindak Pidana Pencemaran Nama Baik? Berdasarkan peraturan perundang-undangan. Hasil penelitian ini terkait dengan peraturan Pasal 310 KUHP dengan Pasal 433 ayat 1 Undang-Undang Republik Indonesia No 1 Tahun 2023 Tentang Kitab Undang-Undang Hukum Pidana, Selanjutnya Surat Edaran tentang penerapan Undang-Undang Informasi dan Transaksi Elektronik Nomor SE/2/11/2021 namun, pada prosesnya tidak adanya kewajiban untuk melakukan penyelesaian tindak pidana pencemaran nama baik melalui Restorative Justice serta tidak diatur secara jelas tentang teknis pelaksanaan didalam Pasal tersebut, pengaturan tindak pidana Pencamaran nama baik melaui Restorative Justice ini dikarenakannya tidak ada aturan khusus yang diatur dalam KUHP, Undang-Undang No 1 Tahun 2023 Tentang Kitab Undang-Undang Hukum Pidana maupun Undang-Undang ITE dalam penyelesaian tersebut, Sehingga penulis mengingkan untuk aturan mengenai tindak pidana pencemaran nama baik melalui restorative justice ini di revisikan kembali baik dari segi sanksi yang didapat ataupun kerugian baik material maupun non material yang didapat oleh korban serta urgensi penerapan prinsip Restorative Justice terhadap tindak pidana pencemaran nama baik, sesungguhnya kita berbicara mengenai persamaan dihadapan hukum atau sering dikenal dengan equality before the law yang mana beberapa dasar perihal urgennya pencemaran nama baik sehingga perlu untuk diterapkannya prinsip restorative justice diantaranya: tujuan hukum, etis (keadilan) yang mana penulis mengrahapkan penerapan keadilan restoratif di Indonesia untuk perkara tindak pidana pecemaran nama baik melalui media sosial mendapatkan perhatian lebih dari pemerintah dengan mengeluarkan sebuah payung hukum atau regulasi yang lebih jelas bahwasanya tindak pidana pencemaran nama baik dapat diselesaikan dengan pendekatan keadilan restorative justice, serta diharapkan pula kepada seluruh pihak penegak hukum agar setiap tindakan yang diambil pada penyelesaian perkara tindak pidana pencemaran nama baik harus berpedoman pada aturan-aturan yang berlaku dan tidak mengesampingkan kepentingan umum lainnya, sehingga dalam melaksanakan tugasnya sebagai penegak hukum dapat memberikan rasa adil kepada masyarakat. Kata Kunci: Tindak Pidana, Pencemaran Nama Baik, Restorative Justice. SETTLEMENT OF CRIMINAL ACTIONS OF DEFAMATION THROUGH SOCIAL MEDIA BASED ON PRINCIPLES OF RESTORATIVE JUSTICE ABSTRACT The aim of this research is to: 1) To examine and analyze the legal regulation of criminal acts of defamation through social media through Restorative Justice. 2) know and analyze the legal urgency in resolving criminal acts of defamation through Restorative Justice. The next problem formulation in this research is: 1) What are the arrangements for resolving criminal acts of defamation through restorative justice, next, 2) What is the urgency so that restorative justice is treated in criminal acts of defamation? Based on statutory regulations. The results of this research are related to the regulations of Article 310 of the Criminal Code with Article 433 paragraph 1 of the Law of the Republic of Indonesia No. 1 of 2023 concerning the Criminal Code, followed by a Circular regarding the application of the Information and Electronic Transactions Law Number SE/2/11/ 2021, however, in the process there is no obligation to resolve criminal acts of defamation through Restorative Justice and there is no clear regulation regarding the technical implementation in this Article, the regulation of criminal acts of Defamation through Restorative Justice is because there are no special rules regulated in the Criminal Code , Law No. 1 of 2023 concerning the Criminal Code and the ITE Law in this settlement, so the author wants the regulations regarding criminal acts of defamation through restorative justice to be revised again both in terms of sanctions obtained and losses both material and non-material obtained by the victim and the urgency of applying the principles of Restorative Justice to criminal acts of defamation, in fact we are talking about equality before the law or often known as equality before the law, which is some of the basics regarding the urgency of defamation so it is necessary to implement it. The principles of restorative justice include: legal, ethical (justice) goals, where the author hopes that the implementation of restorative justice in Indonesia for cases of criminal acts of defamation through social media will receive more attention from the government by issuing a clearer legal umbrella or regulation regarding criminal acts of defamation. reputation can be resolved using a restorative justice approach, and it is also hoped that all law enforcement parties ensure that every action taken in resolving a criminal defamation case must be guided by the applicable rules and not ignore other public interests, so that in carrying out their duties as a law enforcer can provide a sense of justice to the community.
