Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis pengaturan perlindungan hukum kerahasiaan identitas anak sebagai korban tindak pidana pemerkosaan dalam pemberitaan media massa menurut peraturan perundang-undangan yang berlaku dan untuk mengetahui dan menganalisis sanksi terhadap media massa yang melakukan pemberitaan identitas anak sebagai korban tindak pidana pemerkosaan. Permasalahan yang akan dibahas dalam skripsi ini adalah: Bagaimana pengaturan perlindungan hukum kerahasiaan identitas anak sebagai korban tindak pidana pemerkosaan dalam pemberitaan media massa menurut peraturan perundang-undangan yang berlaku dan Apakah sanksi terhadap media massa yang melakukan pemberitaan identitas anak sebagai korban tindak pidana pemerkosaan. Tipe penelitian yang digunakan dalam penelitian ini merupakan penelitian Hukum Normatif yaitu penelitian yang memiliki objek kajian tentang kaidah atau aturan hukum. Hasil penelitian menunjukkan bahwa Perlindungan hukum terhadap kerahasiaan identitas anak sebagai korban tindak pidana pemerkosaan dalam pemberitaan media massa diatur dalam beberapa peraturan perundang-undangan yaitu: 1). Undang-Undang Nomor 40 Tahun 1999 Tentang Pers, 2). Undang-Undang Nomor 32 Tahun 2002 Tentang Penyiaran, 3). Undang-Undang No. 13 Tahun 2006 Tentang Perlindungan Saksi dan Korban, 4). Undang-Undang No. 11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak, 5). Undang-Undang No. 35 Tahun 2014 tentang Perubahan Atas Undang-Undang No. 23 Tahun 2002 Tentang Perlindungan Anak. Sanksi yang diberikan kepada media massa berupa sanksi pidana penjara dan pidana denda. This research aims to determine and analyze the legal protection arrangements for the confidentiality of the identity of children as victims of criminal acts of rape in mass media reporting according to applicable laws and regulations and to determine and analyze sanctions against mass media that report the identity of children as victims of criminal acts of rape. The problems that will be discussed in this thesis are: How is the legal protection for the confidentiality of the identity of children as victims of the crime of rape regulated in mass media reporting according to applicable laws and regulations and what are the sanctions against mass media that report the identity of children as victims of the crime of rape? The type of research used in this research is Normative Law research, namely research that has as its object the study of legal rules or regulations. The research results show that legal protection for the confidentiality of children's identities as victims of criminal acts of rape in mass media reporting is regulated in several statutory regulations, namely: 1). Law Number 40 of 1999 concerning the Press, 2). Law Number 32 of 2002 concerning Broadcasting, 3). Law no. 13 of 2006 concerning Witness and Victim Protection, 4). Law no. 11 of 2012 concerning the Juvenile Criminal Justice System, 5). Law no. 35 of 2014 concerning Amendments to Law no. 23 of 2002 concerning Child Protection. The sanctions given to the mass media are in the form of imprisonment and fines.
