Abstract

Title eksekutorial yang berbunyi “Demi Keadilan Berdasarkan Ketuhanan Yang Maha Esa” bukan hanya terdapat di dalam putusan pengadilan melainkan dapat ditemukan juga pada akta autentik seperti yang dimaksudkan pasal 224 HIR/258 RBg yang mengatur menganai grosse akta. Tujuan dari penelitian ini adalah untuk mengetahui dan menganalisis kekuatan eksekusi dari grosse akta pengakuan hutang dalam mempercepat proses penyelesaian perkara hutang piutang pada hukum acara perdata, serta bagaimanakah grosse akta pengakuan hutang tersebut berfungsi sebagai perlindungan hukum kepada kreditur apabila debitur wanprestasi. Tipe penelitian yang dipakai dalam penelitian ini adalah yuridis normatif, sedangkan pendekatan yang dipakai yaitu Pendekatan Perundang-Undangan (Statue Approach) dan Pendekatan Konseptual (Conseptual Approach). Bahan hukum yang dipakai dalam penelitian ini yaitu bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Hasil dari penelitian menunjukkan bahwa grosse akta pengakuan hutang kendapitun hanyalah berbentuk salinan namun berperan penting dalam mempercepat proses penyelesaian suatu perkara hutang piutang, dimana grosse akta pengakuan hutang ini mempunyai kekuatan pembuktian yang sama dengan akta aslinya. Selain itu kekuatan eksekutorial yang dimiliki memberikan manfaat dapat dilaksanakannya eksekusi (lelang) tanpa lebih dulu melalui proses pengadilan dan kekuatan hukumnya sama seperti putusan hakim pengadilan yang berkekuatan hukum tetap. The executorial title which reads "For the sake of justice based on belief in the Almighty God" is not only found in court executions but can also be found in authentic deeds as referred to in article 224 HIR/258 RBg which regulates grosse deeds. The purpose of this research is to determine and analyze the power of execution of the grosse debt acknowledgment deed in speeding up the process of resolving debt cases under civil procedural law, as well as how the grosse debt acknowledgment deed functions as legal protection for the creditor if the debtor defaults. The type of research used in this research is normative juridical, while the approaches used are the Statute Approach and the Conceptual Approach. The legal materials used in this research are primary legal materials, secondary legal materials and tertiary legal materials. The results of the research show that the grosse deed of acknowledgment of debt is only in the form of a copy but plays an important role in speeding up the process of resolving a debt case, where the grosse of the deed of acknowledgment of debt has the same evidentiary power as the original deed. Apart from that, its executive power provides the benefit of being able to carry out executions (auctions) without first going through a court process and has the same legal force as a court judge's decision which has permanent legal force.
