Abstract

The emergence of the Roblox gaming platform, as part of the broader Metaverse phenomenon, has posed significant challenges to trademark protection in Indonesia. On this platform, users frequently buy, sell, and trade virtual items such as clothing and accessories, often incorporating well-known marks without authorization. This practice raises concerns, particularly regarding the application of the Trademarks Act No. 20 of 2016 in regulating the unauthorized use of well-known marks in the Metaverse, an area not explicitly addressed by Indonesian law. The unlicensed use of trademarks in digital environments infringes intellectual property rights, jeopardizes brand reputation, and undermines trademark exclusivity. This research critically examines the Trademark Act in relation to the use of well-known marks on Roblox and explores potential legal protections for trademark holders in virtual spaces. Using a normative juridical approach with a legislative perspective, the study identifies gaps and ambiguities in the current application of the Trademark Act in the digital realm. The findings show that while the Act provides a legal foundation for trademark protection, significant gaps remain in addressing violations on digital platforms. Therefore, this study recommends developing more specific and adaptive regulations to address the rapid technological evolution. Additionally, Roblox is advised to enhance preventive protection measures, such as stricter verification and controls over the use of well-known marks, to prevent violations and protect intellectual property rights in virtual spaces. This research underscores the need for responsive legal frameworks to keep pace with the evolving virtual marketplace.
