Abstract

The growth of Indonesia's creative industry has given rise to a diverse array of digital works, including Real Person Fiction. Real Person Fiction refers to fictional narratives that incorporate the personification and social interactions of real individuals, usually public figures, as characters within the story. As a form of creative expression, the creation and development of such works are governed by copyright law. Accordingly, the author is vested with exclusive rights, encompassing both moral and economic rights over their intellectual creation. Nevertheless, the unauthorized use of real individuals' personification in such works raises legal concerns. The Republic of Indonesia Act Number 28 of 2014 on Copyright does not explicitly regulate the protection of real individuals within the context of Real Person Fiction. This issue is further complicated by the intersection between copyright law and the right of publicity, potentially infringing upon the personal rights of the individuals portrayed. Therefore, this study aims to analyse the legal implications of utilizing real individuals' personification in Real Person Fiction within the framework of the Indonesian Copyright Act. This research employs normative legal methodology with statutory, conceptual, case study, and comparative approaches. The findings highlight the urgency of amending the copyright regulation to broaden the scope of protected subjects under neighbouring rights. Furthermore, the legal status of real individuals depicted in Real Person Fiction should be explicitly recognized as part of an integrated acknowledgment of the right of publicity within the Copyright Act. Clear regulations for Real Person Fiction are essential to protect authors' rights and respect the personal rights of those depicted in the works.
