Abstract

ABSTRAK Penulisan ini bertujuan untuk memahami dan menganalisis penyelesaian tindak pidana penyalahguna narkotika oleh anak dalam pendekatan restorative justice, serta memahami dan menganalisis kendala yang dihadapi oleh pihak penyidik ditresnarkoba Polda Jambi dalam penyelesaian tindak pidana penyalahguna narkotika oleh anak dalam pendekatan restorative justice. penulisan ini menggunakan metode yuridis empiris dengan lokasi penelitian di Polda Jambi. Adapun bahan hukumnya terdiri dari bahan hukum primer, sekunder, dan terseier, diklasifikasikan dengan analisis data dalam penelitian ini berasal dari penelitian kualitatif. Hasil penelitian ini menunjukkan bahwa penyelesaian tindak pidana penyalahguna narkotika oleh anak dalam pendekatan restorative justice pada Perpol Nomor 8 Tahun 2021 Tentang Penanganan Tindak Pidana Berdasarkan Keadilan Restoratif belum diterapkan secara maksimal maksimal yang dimana kasus anak yang menjadi penyalahguna narkotika cenderung mengedepankan proses pidana karena disebabkan beberapa faktor. Penyidik Ditresnarkoba Polda Jambi dalam penyelesaian tindak pidana penyalahguna narkotika oleh anak dalam pendekatan restorative justice masih mengalami beberapa kendala, salah satunya terletak pada karakteristik kasus narkoba itu sendiri, di mana anak-anak yang berurusan dengan hukum seringkali tidak hanya sebagai pengguna, melainkan juga terindikasi sebagai pengedar, meskipun dalam skala kecil atau atas suruhan pihak lain. Untuk menanggulangi kendala ini, pihak Polda Jambi mengupayakan ketegasan untuk membedakan penyalahguna dengan penyalahgunaan yang dilakukan oleh anak, dan perkuat pelaksanaan diversi yang konsisten dengan refresh pengatahuan dan lakukan pendalaman UU No. 11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak dan Perpol Nomor 8 Tahun 2021 Tentang Penanganan Tindak Pidana Berdasarkan Keadilan Restorative. Kata kunci: Keadila Restoratif, Anak, Penyalahguna Nakotika This writing aims to understand and analyze the resolution of the criminal act of narcotic abuse by children through the restorative justice approach, as well as understand and analyze the obstacles faced by the investigators of the Jambi Regional Police in solving the settlement of the crime of narcotic abuse by children through the restorative justice approach. This writing uses empirical legal methods with the research location at Polda Jambi. The legal material consists of primary, secondary, and tertiary legal materials, classified by data analysis in this study comes from qualitative research. The results of this study show that the resolution of the criminal act of narcotics abuse by children through the restorative justice approach in the National Regulation Number 8 of 2021 Regarding the Handling of Criminal Acts Based on Restorative Justice has not been applied to the maximum, where cases of children who are narcotics abusers tend to prioritize the criminal process because it is caused by several factors. Investigators of Ditresnarkoba Polda Jambi in solving the criminal act of narcotics abuse by children through a restorative justice approach still experiencing several obstacles, one of which lies in the characteristics of the drug case itself, where children who deal with the law are often not only as users, but also indicated as dealers, although on a small scale or on behalf of other parties. To overcome this obstacle, the Jambi Regional Police strives to be firm to distinguish abusers from abuse committed by children, and to reinforce the implementation of diversity that is consistent with the refresh of knowledge and deepen the Law No. 11 of 2012 Concerning the Juvenile Criminal Justice System and Perpol Number 8 of 2021 Regarding the Handling of Criminal Acts Based on Restorative Justice.
