Abstract

Tujuan penelitian ini adalah untuk mengetahui dan menganalisis perlindungan data pribadi pengguna e-commerce di Indonesia, dan perlindungan data pribadi yang disediakan oleh layanan e-commerce, serta tanggung jawab penyedia layanan e-commerce ketika terjadi kebocoran data pribadi. Permasalahan yang akan dibahas adalah pertama, apa saja bentuk perlindungan hukum data pribadi pengguna layanan e-commerce berdasarkan Peraturan Perundang-Undangan dan kebijakan privasi yang disediakan e-commerce di Indonesia. kedua, bagaimana tanggung jawab penyedia layanan e-commerce ketika terjadi kebocoran data pribadi pengguna. Tipe penelitian ini adalah tipe penelitian Hukum Normatif. Hasil penelitian menunjukan bahwa bentuk perlindungan terkait kebocoran data pribadi berupa perlindungan preventif, hal tersebut terdapat dalam beberapa regulasi yaitu UU ITE, UUPK, PERMEN KOMINFO No. 20/2016 Tentang PDPSE dan PP No.71/2019 Tentang PSTE, namun semua regulasi tersebut tidak menjelaskan secara spesifik data pribadi milik orang seperti apa yang patut di lindungi, ruang lingkup terkait data pribadi, dan tanggung jawab e-commerce ketika terjadi kebocoran data pribadi. perlindungan preventif juga disediakan oleh e-commerce dalam bentuk kebijakan privasi. tanggung-jawab penyedia layanan e-commerce dalam transaksi marketplace ketika terjadi kebocoran data pribadi dengan melakukan pemberitahuan terjadinya kebocoran data. Terkait kerugian yang dialami pengguna akibat kebocoran data baru muncul, ketika pengguna mengajukan pengaduan ke menteri KOMINFO atas kerugian yang di alaminya. Kata kunci : Perlindungan Hukum, Data Pribadi, E-Commerce, Marketplace The purpose of this study is to determine and analyze the protection of personal data of e-commerce users in Indonesia, and the protection of personal data provided by e-commerce services, as well as the responsibilities of e-commerce service providers when personal data leaks occur. The problems that will be discussed are first, what are the forms of legal protection of personal data of e-commerce service users based on the laws and regulations and privacy policies provided by e-commerce in Indonesia. second, what is the responsibility of the e-commerce service provider when a user's personal data leak occurs. This type of research is a type of normative law research. The results show that the form of protection related to personal data leakage is in the form of preventive protection, this is contained in several regulations, namely the ITE Law, UUPK, PERMEN KOMINFO No. 20/2016 concerning PDPSE and PP No. 71/2019 Regarding PSTE, but all of these regulations do not specifically explain what personal data belonging to people should be protected, the scope of personal data, and e-commerce responsibilities when data leaks occur. personal. Preventive protection is also provided by e-commerce in the form of a privacy policy. the responsibility of e-commerce service providers in marketplace transactions when personal data leaks occur by notifying the occurrence of data leaks. Regarding the losses suffered by users due to data leaks, it only appeared when users submitted complaints to the Ministry of Communication and Information Technology for the losses they experienced.
