Abstract

ABSTRAK Penelitian ini bertujuan untuk mengetahui dan menganalisis perlindungan hukum pekerja harian lepas pada perusahaan crumb rubber di Kecamatan Pelepat Kabupaten Bungo selain itu juga untuk mengetahui dan menganalisis kendala yang dihadapi dalam perlindungan hukum pekerja harian lepas. Pada perusahaan Crumb Rubber di Kecamatan Pelepat Kabupaten Bungo yang mempekerjakan pekerja harian lepas terdapat kesenjangan dimana tidak dipenuhinya hak santunan berupa uang terhadap pekerja harian lepas yang mengalami kecelakaan kerja termasuk penyakit akibat kerja, dimana mengenai hal ini telah diatur dalam Peraturan Pemerintah tentang penyelenggaraan program kecelakaan kerja dan jaminan kematian. Metode pada penelitian ini menggunakan metode penelitian yuridis empiris yang dilakukan dengan cara penelitian dilapangan, dalam mengambil data menggunakan teknik wawancara dengan responden dan informan. Dari hasil penelitian ini menunjukan bahwa perusahaan crumb rubber tidak memenuhi hak pekerja harian lepas yang berkaitan dengan santunan berupa uang jika terjadi kecelakaan kerja, perusahaan hanya sebatas memberikan santunan pertama saat terjadi kecelakaan kerja. Terdapat beberapa kendala dalam hal perlindungan hukum pekerja harian lepas seperti, kondisi keuangan perusahaan yang mengalami defisit pasca pandemi, rendahnya pengetahuan tentang hak dan kewajiban para pihak serta rendahnya kesadaran hukum pihak perusahaan. Di dalam Undang-Undang Ketenagakerjaan dan Peraturan Pemerintah tentang penyelenggaraan program kecelakaan kerja dan jaminan kematian telah diatur mengenai hak-hak pekerja harian lepas dan kewajiban perusahaan. Perusahaan wajib memberikan hak pekerja harian lepas secara penuh sehingga pekerja harian lepas tidak dirugikan dan mendapat kesejahteraan. Kata Kunci: Perlindungan Hukum, Pekerja Harian Lepas, Perusahaan Crumb rubber ABSTRACT This study aims to determine and analyze the legal protection of freelance daily workers in crumb rubber companies in Pelepat District, Bungo Regency in addition to knowing and analyzing the obstacles faced in the legal protection of freelance daily workers. In the Crumb Rubber company in Pelepat District, Bungo Regency that employs freelance daily workers, there is a gap where the right to compensation in the form of money is not fulfilled for casual daily workers who experience work accidents including occupational diseases, which regarding this matter has been regulated in the Government Regulation on the implementation of work accident and death insurance programs. The method in this study uses empirical juridical research methods carried out by means of field research, in taking data using interview techniques with respondents and informants. From the results of this study, it shows that crumb rubber companies do not fulfill the rights of freelance daily workers related to compensation in the form of money in the event of a work accident, the company is only limited to providing first compensation when a work accident occurs. There are several obstacles in terms of legal protection for freelance daily workers, such as the company's financial condition which is experiencing a post-pandemic deficit, Low knowledge of the rights and obligations of the parties and low legal awareness of the company. In the Manpower Law and Government Regulations regarding the implementation of work accident and death insurance programs, the rights of casual daily workers and company obligations have been regulated. Companies are obliged to provide full rights for freelance daily workers so that freelance daily workers are not harmed and get welfare.
