Abstract
The threat of criminal fines in Law Number 35 of 2009 concerning Narcotics is very high. The penalty is a fine ranging from one hundred million rupiah to twenty billion rupiah. However, the high threat of a fine is inversely proportional to the criminal provisions in lieu of fines regulated in Article 148 of the Narcotics Law, namely a maximum prison sentence of 2 (two) years. It is feared that the threat of a fine will result in the convict not paying the fine and preferring a substitute prison sentence. This will have implications for the success of the goals that the drafters of the law wanted to achieve in threatening criminal fines in the Narcotics Law. This research aims to determine the effectiveness of the implementation of fines for narcotics crimes at the Jambi District Prosecutor's Office and the inhibiting factors in the implementation of fines for narcotics crimes at the Jambi District Prosecutor's Office. This research uses empirical juridical methods. The data analysis used is a qualitative approach to primary data and secondary data. The results of the research can be concluded that the implementation of criminal fines for narcotics crimes at the Jambi District Prosecutor's Office has not been carried out effectively in the last 3 (three) years, in 2020 there were 521, in 2021 there were 530, and in 2022 there were 276 with a total of 1,326 Of the many cases of narcotics crimes, not a single prisoner has so far paid the fines imposed on him. In the implementation of criminal fines in narcotics crimes, there are many inhibiting factors, namely high fines, low compensation penalties and no regulations that force prisoners to pay fines even if only in installments and forcibly taking prisoners' assets.
