Abstract

Drug abuse is one of the serious issues with widespread impacts, including on children as victims. Children who fall victim to drug abuse often suffer not only physical and psychological harm but also face social stigma and legal treatment that is inconsistent with the principles of child protection. This study aims to analyze the rights of children as victims of drug abuse from both national and international legal perspectives and evaluate the legal policies implemented in Indonesia. The study also examines the implementation of legal protection for child victims of drug abuse through relevant case studies. The findings indicate that despite the existence of various laws regulating child protection, such as Law Number 35 of 2014 on Child Protection and Law Number 35 of 2009 on Narcotics, practical implementation still faces numerous challenges, including the lack of rehabilitative approaches and limited understanding among law enforcement officials regarding the principle of the best interests of the child. This research recommends more integrated legal policies focused on the rehabilitation and recovery of child victims of drug abuse, in accordance with international standards as stipulated in the Convention on the Rights of the Child. Thus, it is hoped that Indonesia's legal system can provide more optimal protection for children who become victims of drug abuse.
