Abstract

ABSTRAK Penelitian ini bertujuan untuk mengetahui dan menganalisis pembagian warisan bagi perempuan Batak Toba dan serta faktor-faktor yang mempengaruhi perubahan dalam pembagian warisan perempuan Batak Toba di Perumahan Aur Duri Permai, Desa Mendalo Darat, Kecamatan Jambi Luar Kota,Muaro Jambi. Masalah yang dibahas adalah bagaimana hak perempuan di dalam hal pembagian warisan Batak toba dan faktor apa yang mempengaruhi perubahan pembagian hak warisan perempuan Batak Toba Di Perumahan Aur Duri Permai Desa Mendalo Darat Kecamatan Jambi Luar Kota Muaro Jambi Provinsi Jambi. Tipe penelitian adalah Yuridis Empiris. Hasil dari penelitian ini adalah Masyarakat Batak Toba Di Perumahan Aur Duri Permai Desa Mendalo Darat Kecamatan Jambi Luar Kota Muaro Jambi Provinsi Jambi untuk anak perempuan suku adat Batak Toba sudah sebagian mendapatkan hak sebagai ahli waris dan sudah setara dengan anak laki-laki dan Masyarakat Batak Toba Di Perumahan Aur Duri Permai Desa Mendalo Darat Kecamatan Jambi Luar Kota Muaro Jambi Provinsi Jambi dalam membagi harta warisan sudah tidak semua mengikuti adat Batak lagi. Pembagian warisan untuk anak perempuan menurut adat Batak Toba Perumahan Aur Duri Permai Desa Mendalo Darat Kecamatan Jambi Luar Kota Muaro Jambi Provinsi Jambi menunjukkan bahwa dalam praktiknya terdapat anak perempuan dari komunitas Batak Toba menerima hak warisan, dan faktor-faktor yang mempengaruhi pembagian warisan untuk anak perempuan menurut adat Batak Toba melibatkan adanya faktor pendidikan, faktor perantauan, faktor ekonomi, faktor agama, faktor sosial, dan faktor keadilan. Kata kunci : Pembagian Warisan, Perempuan Batak Toba. ABSTRACT This study aims to determine and analyze the distribution of inheritance for Batak Toba women and the factors that influence changes in the distribution of inheritance for Batak Toba women in the Aur Duri Permai Housing Complex, Mendalo Darat Village, Jambi Luar Kota District, Muaro Jambi. The problems discussed are how women's rights are in terms of the distribution of Batak Toba inheritance and what factors influence changes in the distribution of inheritance rights for Batak Toba women in the Aur Duri Permai Housing Complex,Mendalo Darat Village, Jambi Luar Kota District, Muaro Jambi, Jambi Province. The type of research is Juridical Empirical. The results of this study are that the Batak Toba Community in the Aur Duri Permai Housing Complex, Mendalo Darat Village, Jambi Luar Kota District, Muaro Jambi, Jambi Province For girls of the Batak Toba tribe have partly received rights as heirs and are equal to boys and the Batak Toba Community in the Aur Duri Permai Housing Complex, Mendalo Darat Village, Jambi Luar Kota District, Muaro Jambi, Jambi Province in dividing inheritance assets no longer follows Batak customs. The distribution of inheritance for daughters according to Batak Toba customs in Aur Duri Permai Housing, Mendalo Darat Village, Jambi Luar District, Muaro Jambi City, Jambi Province shows that in practice there are daughters from the Batak Toba community who receive inheritance rights.. and the factors that influence the distribution of inheritance for daughters according to Batak Toba customs involve educational factors, migration factors, economic factors, religious factors, social factors, and justice factors.
