Abstract
Abstrak Penelitian ini bertujuan untuk mengetahui dan menganalisis urgensi penerapan uji validasi barang bukti tindak pidana narkotika oleh kejaksaan di Kejaksaan Negeri Jambi dan kendala yang mempengaruhi penerapan uji validasi barang bukti tindak pidana narkotika oleh kejaksaan di Kejaksaan Negeri Jambi. Rumusan masalah adalah: 1) Apa sajakah urgensi penerapan uji validasi barang bukti tindak pidana narkotika oleh kejaksaan di Kejaksaan Negeri Jambi? 2) Apa sajakah kendala yang mempengaruhi penerapan uji validasi barang bukti tindak pidana narkotika oleh kejaksaan di Kejaksaan Negeri Jambi? Tipe penelitian yang digunakan dalam penulisan skripsi ini, yuridis empiris yaitu melihat antara aturan hukum yang seharusnya, law in the books (Das sollen) dan penerapan hukum dalam kenyataan law in action (Das sein). Hasil penelitian ini menunjukkan bahwa: 1) Penerapan uji validasi terhadap keaslian dan berat barang bukti tindak pidana narkotika oleh kejaksaan di Kejaksaan Negeri Jambi, belum dilaksanakan secara optimal hal ini disebabkan karena pengadaan alat tes kandungan narkotika atau disebut serspro baru tersedia hanya pada Kejaksaan Tinggi Jambi. Kejaksaan Negeri Jambi belum memiliki alat tes kandungan narkotika secara mandiri dan dalam penerapannya regulasi tersebut masih memerlukan koordinasi dan penyesuaian prosedur antara Kejaksaan Negeri Jambi dan Kejaksaan Tinggi Jambi. Disisi lain urgensi penerapan uji validasi barang bukti tindak pidana narkotika oleh kejaksaan tersebut, untuk mengantisipasi dan memberikan pengawasan yang berlapis dengan cara double check barang bukti tindak pidana narkotika yang dilimpahkan oleh penyidik pada tahap II dan nantinya akan digunakan sebagai pembuktian dalam persidangan keaslian dan berat tetap berada dalam kondisi yang tidak mengalami perubahan karena, dalam kenyataannya tidak sedikit barang bukti tindak pidana narkotika pada tingkat penyidikan yang malah ditukar, dikurangi, disisihkan, lalu disalahgunakan oleh oknum. 2) Kendala dalam melakukan uji validasi terhadap keaslian dan berat barang bukti tindak pidana narkotika oleh kejaksaan di Kejaksaan Negeri Jambi dilihat dari faktor-faktor yang mempengaruhi penegakan hukum masih belum berjalan dengan optimal atau masih menemui beberapa kendala yaitu, dalam hal substansi hukum aturannya masih berupa surat edaran yang bersifat himbauan tidak dapat dijadikan dasar hukum yang mengikat dan memaksa seluruh pihak yang menerapkannya, dalam hal penegakan hukum ketidaktahuan penyidik akan adanya regulasi dari surat edaran tersebut, dan dalam hal sarana dan fasilitas keterbatasan alat tes kandungan narkotika dan keterbatasan sumber daya manusia dalam mengoperasikan alat tes kandungan narkotika. ABSTRACT This research aims to determine and analyze the urgency of implementing evidence validation tests for narcotics offenses by the prosecutor's office at the Jambi District Attorney's Office and the obstacles affecting the implementation of evidence validation tests for narcotics offenses by the prosecutor's office at the Jambi District Attorney's Office. The problem formulation is: 1) What are the urgencies of implementing evidence validation tests for narcotics crimes by the prosecutor's office at the Jambi District Attorney's Office? 2) What are the obstacles affecting the implementation of evidence validation tests for narcotics offenses by the prosecutor's office at the Jambi District Attorney's Office? The type of research used in the writing of this thesis is empirical juridical, which examines the gap between the legal rules as they should be, law in the books (Das sollen), and the application of the law in reality, law in action (Das sein). The results of this study indicate that: 1) The implementation of validation tests for the authenticity and weight of narcotics crime evidence by the prosecutor's office at the Jambi District Attorney's Office has not been carried out optimally. This is due to the fact that narcotics content testing equipment, also known as serspro, is only available at the Jambi High Prosecutor's Office. The Jambi District Attorney's Office does not yet have narcotic content testing equipment independently, and in its implementation, the regulation still requires coordination and procedural adjustments between the Jambi District Attorney's Office and the Jambi High Prosecutor's Office. On the other hand, the urgency of implementing the validation test for narcotics crime evidence by the prosecutor's office is to anticipate and provide layered supervision by double-checking the narcotics crime evidence handed over by the investigator at stage II, which will later be used as proof in court. The authenticity and weight must remain unchanged because, in reality, many narcotics crime evidence at the investigation level have been swapped, reduced, set aside, and misused by certain individuals. 2) The obstacles in conducting validation tests on the authenticity and weight of narcotics crime evidence by the prosecutor's office at the Jambi District Attorney's Office, viewed from the factors affecting law enforcement, are still not optimal or encounter several obstacles, namely, in terms of legal substance, the regulations are still in the form of circular letters that are advisory in nature and cannot be used as binding legal grounds that compel all parties applying them; in terms of law enforcement, the investigators' lack of knowledge about the regulations in the circular letters; and in terms of facilities and infrastructure, the limitations of narcotics content testing equipment and the limited human resources to operate the narcotics content testing equipment.
