Abstract

This research aims to analyze the legal basis and the possibility of granting immaterial compensation claims arising from breach of contract in Indonesian private law. The issue arises due to the tendency of courts to grant immaterial damages more frequently in tort cases than in breach of contract cases. The method used is normative juridical research with statutory and case approaches. The study employs primary, secondary, and tertiary legal materials, analyzed qualitatively. The findings reveal that although Article 1243 of the Indonesian Civil Code does not explicitly mention immaterial losses, such claims can still be justified through systematic and evolutionary interpretation of contract law. Several court decisions support the recognition of immaterial damages resulting from breach of contract, although such recognition remains limited. The study concludes that immaterial losses can be granted if there is clear evidence of actual harm and a strong causal relationship. The researcher recommends that the Supreme Court issue clearer guidelines for lower courts and that legal reform be undertaken to explicitly accommodate immaterial damages in breach of contract cases.
