Abstract

ABSTRAK Tujuan penelitian ini adalah untuk mengetahui implementasi peranan Bagian Hukum Sekretariat Daerah Kota Jambi dalam pembentukan peraturan daerah ditinjau dari Peraturan Walikota Jambi Nomor 28 tahun 2021 serta faktor yang menghambat Bagian Hukum Sekretariat Daerah Kota Jambi dalam menjalankan tugas dan fungsinya dalam pembentukan Produk Hukum Daerah. Metode Penelitian yang digunakan adalah metode yuridis empiris. Hasil penelitian adalah implementasi peran Bagian Hukum Sekretariat Daerah Kota Jambi dalam pembentukan peraturan daerah melakukan persiapan dengan melakukan penyusunan SK, selanjutnya dilakukan pembentukan SK sesuai dengan Peraturan Walikota Jambi Nomor 28 Tahun 2021 Tentang Pembentukan Produk Hukum Daerah Dilingkungan Pemerintah Kota Jambi, Pembentukan tim pemerkasa, setelah dibahas bersama peraturan daerah tersebut dilakukan harmonisasi ke Kemenkumham dan Bagian Hukum ikut serta memfasilitasi ke Biro Hukum Provinsi. Penyusunan Peraturan daerah ini masih mengacu ke Undang–Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan serta Peraturan Menteri Dalam Negeri Nomor 80 Tahun 2015 tentang Produk Hukum Daerah serta Kurangnya sumber daya manusia pada Bagian Hukum Sekretriat Daerah Kota Jambi terutama pada Subbag Perundang-Undangan, Belum adanya pelatihan–pelatihan terstruktur yang masif bagi Staf Subbag Perundang- Undangan, Biaya pendidikan Jabatan Fungsional Perancang Perundang-undangan tinggi. Kata Kunci : Peranan, Bagian Hukum Sekretariat Daerah Kota Jambi, Pembentukan Peraturan Daerah ABSTRACT The purpose of this study is to determine the implementation of the role of the Legal Section of the Jambi City Regional Secretariat in the formation of regional regulations reviewed from the Jambi Mayor's Regulation Number 28 of 2021 and the factors that hinder the Legal Section of the Jambi City Regional Secretariat in carrying out its duties and functions in the formation of Regional Legal Products. The research method used is the empirical juridical method. The results of the study are the implementation of the role of the Legal Section of the Jambi City Regional Secretariat in the formation of regional regulations by making preparations by drafting a Decree, then the Decree is formed in accordance with the Jambi Mayor's Regulation Number 28 of 2021 concerning the Formation of Regional Legal Products within the Jambi City Government, the formation of a team of enforcers, after being discussed together with the regional regulations, harmonization is carried out with the Ministry of Law and Human Rights and the Legal Section participates in facilitating the Provincial Legal Bureau. The drafting of this Regional Regulation still refers to Law Number 12 of 2011 concerning the Formation of Legislation and Regulation of the Minister of Home Affairs Number 80 of 2015 concerning Regional Legal Products. This is compounded by the lack of human resources in the Legal Section of the Jambi City Regional Secretariat, especially in the Legislation Sub-Division. The lack of structured, massive training for Legislation Sub-Division staff. The high cost of education for the Legislation Drafting Functional Position.
