Abstract

PENGARUH PERUBAHAN REGULASI PERSAINGAN USAHA TERHADAP PUTUSAN KPPU DI INDONESIA ABSTRAK Penelitian ini bertujuan untuk menganalisis pengaruh perubahan regulasi persaingan usaha terhadap putusan Komisi Pengawas Persaingan Usaha (KPPU) di Indonesia, khususnya setelah diberlakukannya Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja dan Perpu Nomor 2 Tahun 2022. Penelitian ini menggunakan metode penelitian hukum yuridis normatif dengan pendekatan undang-undang dan konseptual, serta teknik pengumpulan bahan hukum primer dan sekunder. Hasil penelitian menunjukkan bahwa perubahan regulasi membawa dampak signifikan terhadap kewenangan lembaga peradilan dan KPPU, termasuk dalam aspek pelaksanaan dan keberatan terhadap putusan KPPU. Perubahan ini mencakup peralihan kewenangan dari Pengadilan Negeri ke Pengadilan Niaga, penghapusan batas maksimal denda, serta dihapusnya sanksi pidana tambahan. Meskipun bertujuan untuk menciptakan iklim usaha yang kondusif dan meningkatkan investasi, perubahan regulasi tersebut juga menimbulkan tantangan dalam penegakan hukum dan kepastian hukum terhadap pelaku usaha. Oleh karena itu, diperlukan sinergi antara KPPU, lembaga peradilan, dan pemangku kepentingan lainnya untuk menjamin keadilan dan efektivitas hukum persaingan di Indonesia. Kata Kunci: Regulasi, Persaingan Usaha, KPPU, Cipta Kerja, Kepastian Hukum ABSTRACT This study aims to analyze the effect of changes in business competition regulations on the decisions of the Business Competition Supervisory Commission (KPPU) in Indonesia, especially after the enactment of Law Number 11 of 2020 concerning Job Creation and Perpu Number 2 of 2022. This study uses a normative legal research method with a statutory and conceptual approach, as well as primary and secondary legal material collection techniques. The results of the study indicate that regulatory changes have a significant impact on the authority of the judiciary and KPPU, including in the aspects of implementing and objecting to KPPU decisions. These changes include the transfer of authority from the District Court to the Commercial Court, the elimination of the maximum fine limit, and the elimination of additional criminal sanctions. Although it aims to create a conducive business climate and increase investment, these regulatory changes also pose challenges in law enforcement and legal certainty for business actors. Therefore, synergy is needed between KPPU, the judiciary, and other stakeholders to ensure the fairness and effectiveness of competition law in Indonesia.
